These terms govern access to Precision Data Systems and the use of the analytics features provided. They apply to all users who access the platform, regardless of whether they retrieve individual dashboards or use comprehensive forecasting models.
Precision Data Systems provides a business intelligence platform that consolidates operational data from various business areas, analyzes it automatically, and visualizes it in individual KPI dashboards. The scope of services depends on the access model you have booked. Please note that the platform prepares decisions but does not provide legally binding recommendations for individual business transactions.
You are responsible for the accuracy and timeliness of the data you upload to the platform. This also includes ensuring that you have the necessary rights to this data and that you do not process personal information without a valid legal basis. We strive to ensure high availability of the platform, but we cannot guarantee uninterrupted accessibility. We will generally announce planned maintenance windows in advance. We assume no liability for outages caused by force majeure, maintenance work, or third-party interference, to the extent permitted by law. The analysis results depend significantly on the quality of the data provided.
The platform is operated with the required care. We are fully liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. For simple negligence, we are liable only in the event of a breach of essential contractual obligations, limited to the typical, foreseeable damage. Liability for indirect damages, lost profits, or data loss exists only in cases mandated by law.
Access to the platform is granted for the agreed term. After the term expires, usage will only be extended if expressly agreed. You may terminate access at any time with fourteen days' notice to the end of the month. We reserve the right to block access without notice in the event of serious contractual violations, such as misuse of data or circumvention of security measures.
We will adjust these terms if legal framework conditions or the range of services change significantly. We will notify you of changes by email to the address provided during registration. If you do not object to a change within six weeks, it will be deemed accepted. We will specifically point out your right to object in the change notification.
